Summary: This course will review the rising popularity of electric bicycles and scooters, particularly emphasizing the substantial increase in related injuries reported in emergency rooms over recent years. We will outline the legal framework governing low-speed electric bicycles and scooters in New Jersey and New York. Help you identify if vehicles do or do not require a license, registration, or insurance coverage. It further elaborates on the legal definition of 'pedestrian' under New Jersey law, clarifying its implications for Personal Injury Protection (PIP) benefits for riders injured on scooters. The text underscores the importance of proper inspections after an incident of the electric bike or scooter to identify compliance with the pertinent rules and regulations. Examine recent legislative and case law updates regarding the operation of these vehicles. We will identify and suggest areas of concerns about illegal modifications to increase speed, which could reclassify them to a higher regulatory category, resulting in potential non coverage or legal consequences. Overall, a comprehensive understanding of these regulations and investigative practices is vital for electric bike and scooter investigators.

Nicholas Hamm, CPCU, CIFI, AIC, AIM

Nicholas Hamm brings 50 years of extensive experience in Special Investigation Units (SIU) and law enforcement to his role as the Director of the Special Investigations Unit at the New Jersey Property-Liability Insurance Guaranty Association. In this position, he successfully established the SIU from the ground up, overseeing both single file and complex major case investigations. Nick has managed a national team of Complex-Major Case SIU Investigators, demonstrating his leadership and expertise across the country.  A recognized expert in the field, Nick holds multiple industry certifications, including Chartered Property Casualty Underwriter (CPCU). He has also served as an advisor and board member for various government and industry agencies, contributing his knowledge and insights to the broader community. A key highlight of Nick's career is his commitment to teaching and mentoring. He takes great pride in nurturing new talent and witnessing their success, particularly within his current SIU team at the New Jersey Property-Liability Insurance Guaranty Association.  Nick resides in north-central New Jersey with his spouse. He is the proud parent of two adult daughters and enjoys spending time with his two active grandchildren. Outside of his professional life, Nick is passionate about fishing, hunting, camping, and other outdoor activities.
